1) Acceptance of Terms

By accessing or using this website, downloads, or services (the “Site”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.

2) Changes to the Terms

We may update these Terms at any time. Changes are effective when posted. Continued use means you accept the updated Terms.

3) Who May Use the Site

You must be at least 13 years old (or older where required by local law). If you’re using the Site on behalf of a school, district, library, or organization, you represent you have authority to accept these Terms.

4) Accounts & Communications

Some features may require an email signup or account. You agree to provide accurate information and to receive service and transactional emails (e.g., download links, educator updates). You can unsubscribe from marketing emails at any time.

5) Intellectual Property

All content on the Site—books, text, images, audio, video, artwork, logos, downloads, and code—is owned by Epodos Media or its licensors and is protected by copyright and other laws. Except as allowed under Section 6 (Educator License), you may not reproduce, distribute, display, or create derivative works without written permission.

6) Educator License (Free Resources)

We love classrooms. Unless a resource says otherwise on its download page, Epodos Media grants a limited, non-exclusive, non-transferable license to:

  • Print or digitally share Epodos educator materials (PDFs, handouts, slides provided by Epodos) with your own students and school for non-commercial classroom use.
  • Post inside a secure LMS (e.g., Google Classroom, Canvas) accessible only to your students and school staff.

What you may not do without written permission:

  • Upload resources to public sites, marketplaces (e.g., TpT, Etsy), or social platforms.
  • Remove copyright notices, watermarks, or attribution.
  • Sell, sublicense, or bundle resources with other products.

7) Purchases & Third-Party Retailers

We may link to third-party retailers (e.g., Amazon). Prices, availability, shipping, and returns are handled by those retailers under their terms. We may receive affiliate revenue from qualifying purchases. Epodos does not control third-party sites and is not responsible for their content or policies.

8) The Lab (Services to Schools/Organizations/Creators)

Epodos Lab engagements are governed by a separate Statement of Work (SOW) or services agreement. If a conflict exists between this page and an SOW, the SOW controls for that engagement.

9) User Submissions & Feedback

If you send ideas, feedback, or materials (collectively, “Feedback”), you grant Epodos a worldwide, royalty-free license to use the Feedback without obligation to you. Do not submit confidential or student-identifying information unless requested and secured under a separate written agreement.

10) Acceptable Use

You agree not to:

  • Violate laws, intellectual property, or privacy rights.
  • Attempt to access non-public systems or interfere with Site operation.
  • Use the Site to harass, spam, or harm others.
  • Data-mine or scrape content except via normal browser use.

11) Accessibility

12) Disclaimers

The Site and all materials are provided “as is” and “as available.” To the fullest extent permitted by law, Epodos disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted or error-free.

13) Limitation of Liability

To the fullest extent permitted by law, Epodos Media and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or materials—even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed US $100.

14) Indemnification

You agree to defend, indemnify, and hold harmless Epodos Media from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms.

15) Links to Third Parties

Links are provided for convenience only. Epodos is not responsible for third-party sites or content. Use them at your own risk and review their policies.

16) DMCA / Copyright Concerns

If you believe content on the Site infringes your copyright, please contact rights@epodosmedia.com with:

  • Your name and contact info,
  • The copyrighted work you claim is infringed,
  • The URL of the allegedly infringing material,
  • A statement of good-faith belief, and
  • A statement under penalty of perjury that your notice is accurate and you are the owner or authorized to act for the owner.

17) Privacy

Your use of the Site is also governed by our Privacy Policy (how we collect, use, and protect data). Please review it.

18) Children’s Privacy

We do not knowingly collect personal information from children under 13 without verifiable parental or school consent consistent with applicable law (including COPPA in the U.S.). If you believe a child provided personal data without consent, contact hello@epodosmedia.com.

19) Governing Law & Venue

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in New Jersey for any dispute not handled in small-claims court.

20) Termination

We may suspend or terminate access to the Site at any time for any reason. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations, indemnity, governing law) will survive.

21) Entire Agreement

These Terms (plus any SOW for Lab services and our Privacy Policy) are the entire agreement between you and Epodos regarding the Site.
